Delhi Development Authority Moves the Delhi High Court Against RERA’s Registration Mandate
Delhi Real Estate Regulatory Authority (RERA) recently issued directives to Delhi
Development Authority (DDA), directing it to register its housing projects following which the
DDA moved Delhi High Court.
The Real Estate (Regulation and Development) Act, 2016 mandates registration of real estate
projects before advertising, marketing, booking, selling or offering for sale, or inviting persons
to purchase it.
However, DDA has claimed that it is not a “promoter” of housing projects under RERA rather
the “competent authority” itself and sanctions its own layout plans. DDA further argues that it
is already subject to robust government oversight to ensure transparency and efficiency and is
not profit- oriented like private developers.
DDA itself being a statutory body and having a pivotal role in Delhi’s development, the
outcome of the matter will be a watershed moment to determine RERA’s jurisdiction over
statutory or government bodies involved in housing developments.
